VerpackG German Packaging Act

The German Packaging Act (VerpackG) is the implementation of the European Packaging Directive into German law. So far this law only applied to B2C. Starting 01.07.2022 all B2B packaging will be affected by this law. Through the Packaging Act, traders are made responsible to participate in the recycling of their product packaging. The law thereby creates an economic incentive for companies to use recyclable packaging and fewer resources altogether. Compliance with the Packaging Act is a step towards more sustainability in e-commerce.

The aim of the Packaging Act is to uphold the principle of product responsibility of the manufacturer. With VerpackG, transparency is created and product responsibility is increased. The goal is to avoid unnecessary packaging waste.


What does product responsibility mean?

Product responsibility means that whoever manufactures and sells a product has to consider the future disposal of the product as early as the development, production and sales stage. He must consider the recyclability of his product and ensure that the product is taken back after use and that it is disposed of responsibly.

Pursuant to VerpackG failing to comply with these obligations can result in monetary fines of up to 200,000 EUR.

The LUCID Packaging Register is visible to the public and any competitor can easily identify if a company is registered or not. In the latter case, German law allows competitors to send a cease and desist letter which can be very costly for the recipient.

What are the obligations under the Packaging Act?

The obligation to register

Every brand that markets or imports packaging filled with goods in Germany is obliged to register in the LUCID packaging register, stating the type of packaging.

The obligation to using a system participation depending on your packaging type

Anyone who places sales, or shipping packaging filled with goods on the German market, which is typically generated as waste, must also assume financial product responsibility for this packaging that is subject to system participation and pay for the recycling of their packaging . This is called system participation. You meet your system participation obligations by concluding a system participation agreement with one or more systems.

After registering and getting your LUCID number, if you are subject to system participation you will get another email directing you to a page to enter data on the amount of packaging you use annually as well as the “system” you decided to use.


What documents are needed to show system participation is active?

System participation should be documented by the upstream distributor on the invoice/delivery note so that the final distributor always has comprehensive compliance documentation. Alternatively, the final distributor needs another form of appropriate documentation to provide evidence that the upstream distributor has participated in the purchased service packaging with a system, in full.

The LUCID Packaging Register operates exclusively electronically. You need a web-enabled device, desktop or mobile, installed with a browser that is sufficiently up-to-date. Your registration in the LUCID Packaging Register can only be completed online. It cannot be undertaken on paper.

  1. Check whether the email is in your spam folder that holds unsolicited e-mail.

  2. Check whether the email was automatically moved to a different folder, e.g. because it was classified as junk mail.

  3. Request that the verification link be re-sent by logging in again under lucid.verpackungsregister.org with your e-mail address and chosen password. Select the “resend activation email” option.
